Online gambling is betting in casinos and/or sports, similar to traditional physical gambling, but conducted on a virtual platform. Instead of cash, online gambling utilizes credit cards for placing bets, with wins and losses processed digitally. It can take various forms, including poker, horse betting, slots, blackjack, roulette, and sports betting through a virtual medium. While the fundamental concept of gambling remains consistent, the lack of a physical experience can be a drawback for many who prefer the glamour of casinos or the excitement of cheering in stadiums.
Online Betting: Is It Legal?
The legal status of online betting varies greatly across India. Prior to the central Public Gambling Act of 1867 (hereinafter referred to as “The Act”), states had their own gambling legislation. The Act declared all forms of gambling illegal in India but distinguished between games of chance and games of skill. This distinction allows betting on games of skill, yet confusion persists regarding what constitutes a game of skill. For instance, cricket does not qualify as a game of skill, while lotteries and horse racing remain legal. This ambiguity illustrates the lack of substantial guidelines to differentiate between games of skill and chance.
Notably, the Act does not explicitly mention online gambling. Some states have adopted the Act as their gambling legislation, while others maintain their own regulations. Sikkim and Nagaland were the first states to include laws concerning online gambling in their statutes. Furthermore, West Bengal, Nagaland, and Sikkim permit both online and offline poker games after obtaining a state authority license, along with Goa, which has authorized casinos for gambling activities.
To directly address whether online betting is legal in India: for now, the answer is yes. No law explicitly states that online gambling is illegal, and while The Act aims to impose a blanket ban on all gambling forms, it lacks sufficient material to clearly define games of skill and chance to classify online gambling as illegal.

Laws Regarding Online Gambling In India
As previously indicated, clarity and standardization regarding online gambling laws are lacking across India. The only significant judgement to reference online gambling is M/s Gaussian Networks Pvt. Ltd. v. Monica Lakhanpal and State of NCT, which stated:
- If a game involving skills is played with stakes, it does not constitute gambling.
- If players are attracted to the game solely for prize money, it is considered illegal.
- Any skill game played for monetary gain on virtual platforms is illegal, even if it is legal in a physical context.
- Gaming sites cannot combine winning hands as it incentivizes online gambling.
This case was ultimately withdrawn during the final arguments, meaning no legal precedent was set. Telangana was among the first states to ban online gambling with legislation in 2017, followed by Kerala, Tamil Nadu, Andhra Pradesh, and most recently, Karnataka. There are ongoing discussions regarding the need for the Union government to block gambling sites to enforce these bans effectively. This has led to significant unrest within the online gambling community, with many bans being challenged by rummy and poker portals. Recently, the Madras High Court had to overturn amendments brought about by state legislation.
In addition, various regulations such as the Prevention of Money Laundering Act 2022, Telecom Commercial Communications Customer Preference Regulations 2010, The Prize Competition Act 1955, Foreign Exchange Management Act 1999, and The Cable Television Network Rules 1994 impose certain restrictions on gambling promotion.
The government has expressed intentions to create a comprehensive legislation to regulate gambling, aiming to curb financial losses and generate revenue through proper taxation. With India emerging as a potential market for gambling, many foreign investors are interested in establishing operations within the country.

Punishment for Illegal Online Gambling in India
In 2018, authorities dismantled an online gambling racket in Delhi, resulting in the arrest of 12 individuals for violating state gambling laws. This incident highlights how the growing availability of technology and internet access facilitates online gambling. Due to the lack of specific online gambling legislation, there are no defined punishments other than those outlined in existing general provisions from the aforementioned laws.
